homosexuality in schools (SB 777 by State Senator Sheila Kuehl - D

On January 1, 2008, SB 777 became law in California. SB 777 deals
primarily with what constitutes discrimination against homosexuals in
schools. Many questions have been asked about the impact of SB 777,
what it has changed, and whether or not it affects private schools,
including private home schools. SB 777 changed numerous sections in
the Education Code. The most significant changes to four sections in
the Education Code are explained in a new detailed analysis, which has
been prepared by Private and Home Educators of California in
conjunction with attorneys at Home School Legal Defense Association.
This new analysis attempts to answer many of the questions that have
been asked about SB 777. We recommend that you read our paper, SB 777
- Private Schools & Private Home Schools (October 17, 2007) before
reading this new analysis.

S.B. 777

California--State Turns Its Back on Traditional Families
Dear HSLDA Members,
There has been much discussion about the impact of S.B. 777, the
sexual orientation bill, and what it means for your family.
It is important to know that this bill does not impact homeschoolers
who are not receiving government education funding. For this reason
HSLDA, and Family Protection Ministries (FPM), our partners in
California on legislative matters, did not actively oppose this bill,
even though we closely monitored it to make sure it would not affect
private homeschoolers. S.B. 777, however, will have a significant
impact on all public and some private education in California.
When California Governor Arnold Schwarzenegger signed S.B. 777, on
October 12, 2007, many were legitimately concerned. This new law will
significantly impair speech supporting the traditional family from
being heard in California public schools. This is accomplished by
making it illegal for school officials to teach the well established
Judeo-Christian principles concerning the family.
Every California parent needs to know what is happening in their
public school system.
To this end, HSLDA encourages you to share this information with
friends, relatives, and church leaders. We believe that Christian
leaders throughout California will conclude that the public school is
no longer serving the best interests of families and that alternative
methods of education need to be promoted.
HSLDA has been at the forefront of homeschooling for nearly 25 years.
During this time, homeschooling has proven itself to be a superior
form of education. If you've experienced the blessings of
homeschooling, we strongly urge you to communicate with other parents
who are concerned about the direction of public schools to consider
homeschooling.
Remember, S.B. 777 also affects charter schools. We agree with Roy
Hanson of FPM that the institutions covered by S.B. 777 include: 1) an
educational institution that receives, or benefits from, state
financial assistance, or 2) an educational institution that enrolls
pupils who receive state student financial aid. Private
homeschoolers, of course, do not fall under either of these

AB 16-HPV Immunizations for Girls Before School Enrollment

Bill: AB 16 - HPV Immunizations for Girls before School Enrollment

We have received a number of calls regarding AB 16 expressing concern
about the proposed requirement for all girls to receive the HPV
vaccination before being enrolled in the 7th grade in any public or
private school, which would include private home-based schools. We
routinely watch all legislation dealing with vaccinations for at least
two reasons: 1) all requirements for children to be vaccinated are
currently linked to school enrollment, which includes home-based
private schools; and 2) no parent should be required to have their
child vaccinated if it is contrary to what they believe is best for
their own child.
AB 16 adds the very questionable and potentially dangerous human
papillomarvirus (HPV) vaccine to the 10 vaccinations currently
required for children before being admitted to specific grades in any
public or private school.
Current law prohibits public and private school officials from
admitting any child to their school unless either: 1) that child has
received all of the vaccinations listed in current law for their grade
level; or 2) the child's parent has signed a waiver indicating that
they do not want their child to receive the "required" vaccinations.
The waiver is documented on the back-side of the "California School
Immunization Record," which is required to be kept on file at the
child's school of enrollment (public or private - including private
home schools). This form is available from your local county health
department. More details, including a sample copy of the "California
School Immunization Record" (Department of Health Form PM268B), are
available in CHEA's manual, "An Introduction to Home Education" (see
pages 5-21 & 8-7 current 10th edition). You can contact CHEA at

AB 16 does not remove this waiver capability. In fact, AB 16, as
currently written, actually adds helpful language, clarifying what
this waiver can cover by stating that the parent can waive "any or all
of the immunizations" that are otherwise required for school
attendance. Unfortunately, almost all public announcements promoting
vaccination of children fail to mention that parents can sign this
waiver.
AB 16 does not make it very easy for parents to get information about
any effects of the HPV vaccination or any risks associated with having
an HPV vaccination. In fact, AB 16 was amended on March 5th to remove
the requirement for doctors who administer the HPV vaccination to
provide written information to the parents concerning the effects of
the vaccination.
We are very concerned about parents being pressured to have their
daughters vaccinated with this HPV vaccination because so little is
known about it and its long-term effects. Also, there have been very
troubling reports of dangerous immediate side effects, such as
fainting and convulsions, at least when the HPV vaccine has been
received in conjunction with other vaccinations. Watch for additional
helpful information concerning vaccinations in Family Protection
Ministry's upcoming March-April newsletter, Legal-Legislative Update.

Bill: AB 755 - "No-Spanking"

This is an update to our previous, February 1, 2007, Newsflash
regarding Assembly Member Sally Lieber's proposed no-spanking
legislation, which was introduced into the California Legislature on
February 22nd as Assembly Bill AB 755.
AB 755 is more severe than we initially expected. AB 755 would
criminalize innocent parents who lovingly spank their child with an
inanimate object like a paddle or switch.
Some of the organizations with whom we are working to oppose this bill
have already asked for opposition letters and calls. We are very
encouraged by their opposition to AB 755. We are also working behind
the scenes at the Capitol while working on other strategies to stop
this bill. The best time to contact legislators on bills like this is
usually after the bill has been assigned to a policy committee and
then scheduled for a hearing. As of today, no date has been set for
AB 755's first committee hearing. We will keep you informed about
what actions you can take to have the greatest impact at the best
strategic time.
Additionally, we are developing background information that will help
every concerned parent: 1) to understand this bill and its
implications for every family in California and the nation, and 2) to
be able to present the most effective reasons why such a bill should
not be passed by the Legislature.
The author appears to be claiming that the public's earlier very vocal
opposition to her original "no-spanking" idea, doesn't apply to her AB
755. The author claims that her bill is not about "spanking" on the
basis that her bill does not contain the word "spanking." However, AB
755 would, in effect, outlaw spanking with the use of a switch,
paddle, or any other reasonable object that many loving, nonabusive
parents normally use as one of the methods to discipline their
children.
Ms. Lieber has redefined the act of spanking with an implement as
child abuse. The language used in her bill in effect states that any
act of causing pain by using an implement (which includes spanking)
will always automatically be illegal. In contrast, current law allows
for the causing of pain with an implement to be justifiable when the
pain is caused by a reasonable spanking as a means of discipline and
without injury.
AB 755 would traumatize families and children by potentially having a
parent arrested, handcuffed, removed from their home and family, and
jailed for up to one year for using nonabusive spanking to the
buttocks to discipline a defiant or rebellious child.
AB 755 is an incremental step toward the outlawing of all spanking,
which the author has publicly stated is her ultimate goal.

If you do call and are asked for your name and phone number, please
consider providing them so that your call against the proposal will be
tallied. The practice of gathering this kind of information is often
used to gain an idea of the extent of support and opposition. Again,
the most effective timing for calls and letters will be after a bill
has been assigned to a policy committee.
AB 755 affects all parents in California. Any contact you make
regarding this issue should be as a California citizen or as a
concerned parent.
We will be issuing an Action Alert on AB 755 within the next few
weeks. As currently written, the bill will be heard some time between
March 27th and April 24th, unless there is a rule waiver. We are
monitoring this bill daily, as we do with all legislation.

Please call the Governor's Office! It takes less than 30 seconds!
I did it-you can too! This takes less than 30 seconds, you don't have to talk to anyone, the Governor is taking a phone poll. Just follow the recorded instructions to veto this bill. Our voices are important and this is a chance to be heard. You will probably see a 30 second long distance call on your phone bill but well worth it. This is our California Senate in action.
Everyone has their opinion. It seems our State Legislators never care to ask what that opinion is. This is your chance to voice an opinion, whatever it may be. The situation is this: Bill SB 1437, was passed and sent to the governor. It requires all textbooks to be rewritten and reissued at a cost that our school system, not to mention taxpayers, can little afford. They will indoctrinate schoolchildren with a homosexual agenda. The bill requires that all new textbooks (K-12) highlight homosexuals and eliminate all references to "mom" and "dad." Instead, they could be referred to as "sperm donors" and "sperm receivers." This bill is ridiculous, it is expensive and it singles out a small, special interest group. We do not need elementary school children exposed to this nonsense. Can you imagine: School proms (Prom "kings" and "queens" could not be gender-specific) Gender-specific sports ("Boys Basketball" would be "discriminatory" against transsexuals) Cheerleading (Can you say "transsexual cheerleaders"?) The governor is doing a phone poll. Urge him to veto this bill. It's very easy, you don't even have to talk to anyone. Parental rights are under attack. We see parental liberty increasingly challenged in the legal and legislative arenas. Although homeschoolers have done much to secure educational freedom for themselves, we recognize that this freedom is only as secure as our rights as parents.
