HOMESCHOOLERS WIN LANDMARK CASE

Purcellville, VA—In a 3-0 decision the California Court of Appeal for the Second Appellate District reversed its earlier ruling which would have required homeschoolers to be certified teachers in order to homeschool in California. “This is a great victory for homeschool freedom,” said Michael Farris, one of the team of attorneys who argued the case before the court and Chairman of HSLDA.

"I have never seen such an impressive array of people and organizations coming to the defense of homeschooling. The team effort was remarkable," he added.

Mr. L of In re Rachel L was represented by Gary Kreep of the U.S. Justice Foundation and the Alliance Defense Fund.

The court agreed to re-hear In re Rachel L in March after a public outcry of its previous February, 2008 ruling. Many new arguments were presented to the court in June. HSLDA filed an amicus brief on behalf of our 15,000 California members. The Governor and Attorney General of California also supported a parent’s right to homeschool before the court.

“Tens of thousands of California parents teaching over 166,000 homeschooled children are now breathing easier this afternoon,” said Farris.

Home School Legal Defense Association (HSLDA) is a 25-year-old, 85,000 member non-profit organization and the preeminent national association advocating the legal right of parents to homeschool their children.

We're kicking off the TOS Summer Reading Splash and would like to invite your family to participate!  (This reading program is open to ANY homeschooled student - you do not have to be a TOS subscriber or a reader of our E-Newsletters in order for your children to participate.)  As a matter of fact, we are so passionate about getting children to read, we'd love for you to share this information with EVERYONE you know!  Please forward this e-mail to all your homeschooling friends and share the news about the Summer Reading Splash!
 

Over the next 3 months, we'll provide lots of great information and creative ideas for encouraging your children to read.  Below, you will see (in more detail) what all we have available to you NOW.  As the summer progresses, we will add more resources to our Splash! website.  You'll want to be checking back often!  In the coming weeks and months, we will be offering several freebies and downloads to enrich your family's reading fun!

We are Blessed !!!!

 

Well folks, it has been a very busy year so far for the homeschool world in our state capitals around the country.

I could not believe how many states, including my own here in Tennessee, that had to go up against the "world of politics" to hold on to our rights to homeschool.

There will always be someone out there, trying to take us under, because they do not agree with what we are doing. For my opinion, I do not see where ignorance on there part should have to be a problem for us.

One thing that I do know is that God is in control and His Will for our lives will be so. These people who are trying to change the laws so that they can feel more comfortable about things, will not prevail !! They are not only going up against all of us homeschoolers, they are going up against the very Word of God dealing with the training of our children.

I will say that I let myself get somewhat concerned at times with some of this but I had to get myself back over to right thinking and remember that nothing is too big for my God !!

So, as we get ready for our summer breaks, let us remember to always take time to thank God for His ways, and His protection on our lives and the lives of our children.

We do have a lot to be thankful for !!!

What is Coming Up on The "History Channel"......

Here is something that is coming up this month:

The Universe: Biggest Things in Space
Tuesday, April 29th at 9PM/8c

The Universe series offers an epic exploration of the universe and its
mysteries, providing an in-depth analysis from the planets to the
stars to the edge of the known. As research into our universe has
become more sophisticated, new secrets are yielded which help us
understand our planet and the world beyond. Robotic rovers give us
eyes on the red rock of Mars, NASA probes slam into comets at hyper
speed, and deep space telescopes capture amazing images of the birth
of stars and their free-fall into black holes.

This one hour episode entitled Biggest Things in Space explores some
of the largest structures and objects in the universe. In this
episode, students will learn about the large concentrations of gas
known as Lyman alpha blobs, which contain countless galaxies. This
program also explains such phenomenon as the formation of super galaxy
clusters which arise as the result of cosmic collisions in space.
Students will learn about the largest planets, stars, black holes,
constellations, and "voids" in space, giving them an opportunity to
discuss the size and dimensions of our universe in relationship to
earth. Educators may want to use clips from this program to set up
debates or prompt conversations among students about the future of
space and its relevance in our everyday lives.

Curriculum Links:
The Universe: Biggest Things in Space is appropriate for high school
students. It would be useful for Science, Astronomy, Earth Sciences,
and Technology courses. Teachers may want to use clips from this
documentary to supplement lesson plans related to astronomy and the
universe, or show one episode in this series in its entirety in order
the highlight one aspect of this topic. It fulfills several National
Standards guidelines as outlined by the National Council for History
Education including 1) Civilization, Cultural Diffusion, and
Innovation, 2) Human Interaction with the Environment.

What In the World Is Going On In California?

By now, most homeschoolers across the country have heard about the California appellate court ruling handed down on February 28 ordering the children of Phillip and Mary Long to attend public school or a legally qualified private school. The judge's ruling surprised everyone and sparked a firestorm of concern among homeschoolers nationwide, many wondering if homeschooling had become illegal in California.

The Old Schoolhouse Magazine staff has been following the developments since World Net Daily first broke the story a week ago. In this Homeschool Minute, we would like to provide a brief summary of the events and offer links to various perspectives to help homeschoolers understand this ruling, how it impacts homeschoolers in California, and what homeschoolers across the nation can do to help.

To gain a better understanding of this case, it is necessary to note that prior to this ruling, the Long family had been involved with the juvenile court system regarding the care of their children. Such proceedings are confidential, and in most cases, a court-appointed attorney is provided to represent the interests of the minor children. The attorney representing two of the children was not satisfied with a ruling made by Superior Court Judge Stephen Marpet, who found the children's education to be "meager" but determined that Phillip and Mary Long have a constitutional right to school their children in their own home. The attorney for the children brought an appeal before the Second Court of Appeals of California.

The California Second Appellate Court in Los Angeles found that the Longs had not demonstrated that any of the exemptions to California's compulsory attendance applied to their children. The court reversed the finding of the Superior Court and ordered the children to attend public or a "legally qualified" private school. The court remanded the case back to the lower court for a hearing to determine if the family was in compliance with the law. The family plans on appealing this ruling decision to the California Supreme Court.

The ruling spurred reactions from attorneys representing various homeschool groups and interested parties across the country. The Homeschool Minute provides these links for informational purposes related to this case and does not necessarily endorse these sites.

Sunland Christian School. The Long children were enrolled in this school.

Pacific Justice Institute (PJI). These attorneys are representing Sunland Christian School and advising the family.

Home School Legal Defense Association (HSLDA). HSLDA presents several appeal options to reverse this ruling or diminish its impact upon California homeschoolers. There is a petition available for those interested in supporting the HSLDA's move to depublish the ruling.

National Home Education Legal Defense (NHELD). Attorney Deborah Stevenson offers a detailed and informative analysis of this case.

California Governor Arnold Schwarzenegger issued a statement in support of homeschooling:

"Every California child deserves a quality education and parents should have the right to decide what's best for their children. Parents should not be penalized for acting in the best interests of their children's education. This outrageous ruling must be overturned by the courts and if the courts don't protect parents' rights then, as elected officials, we will."

By the end of a long news week, the court decision reached the broader Christian community through a radio broadcast by Focus on the Family. Dr. Dobson discussed the California court case with several prominent guests.
