The information below is from a page on the Dept. of Education site for Indiana: The Relationship Between Public Schools and Home Schools. Though this site is directed to teachers and those involved in education, to educate them with the law and what they have rights to do in IN, it also tells the laws and rights we have as homeschoolers, so it may be worth a look.It states the legal loopholes already set up to catch truly bad parents who are not properly educating their children at home. I think that is a good thing. I don't consider these children homeschooled, if they are brought home and left to their own devices. CAN PARENTS ALREADY IN TROUBLE FOR EVENTS OCCURRING IN THE PUBLIC SCHOOL (I.E., TRUANCY OR EDUCATIONAL NEGLECT) AVOID LEGAL ACTION BY Not necessarily. While public schools have no jurisdiction over children once they are transferred to a nonpublic school, the transfer does not "clean the slate" of past bad behavior. Prosecutors may pursue charges brought prior to withdrawal if they believe it is in a child's best interest. This is as it should be, according to our Constitution.. If there is something wrong and a parent is trying to stay out of the sight of officials - or the public, for that matter- people will know. If there is a prior record/history, then that is how our gov't works: use that information. Otherwise, an official cannot just suspect something and take over the parental responsibility. Do not give up that freedom and right. It how we protect our children from harm.
Persons with specific reasons to believe a parent is unable or unwilling to educate his or her school-aged child are obligated to report this to the county child protective services office (IC 31-33-5-2). However, the solitary facts that a parent chooses to home educate, and/or fails to notify the State of his or her home school's grade level enrollment ("register"), are not, in and of themselves, cause for such a report, nor do they constitute educational neglect in and of themselves. Anyone who intentionally files a fraudulent report may be subject to prosecution for malicious reporting under Indiana law. "The home educating parent has assumed legal responsibility for the child's education and will be held accountable...." I LOVE THIS! We are taking responsibility for our children! We really are. Even the state knows that. More importantly than the standards of the state, we are held to a higher standard: God's. That is for every parent in every state and country in the history of the world! There is the General Diploma Requirements, the Core40 Diploma requirements, and the Academic Honors Diploma requirements.
