Should Homeschooling Be Illegal? Take the Poll!

Parade Magazine is asking if parents should be required to have teaching credentials in order to teach their children. Please go to this site and make your voice heard: Intelligence Report | PARADE Magazine

In February, a California state appeals court ruled that unless parents have recognized teaching credentials, they must send their children to school. The judge, citing a state education law, said that "parents do not have a constitutional right to home-school their children." Parents and politicians were outraged, and the court will rehear the case this month.

At stake is the education of the 166,000 California children who currently are home-schooled. But the court decision also could influence laws across the country. Nationwide, up to 2 million children are taught at home. Experts estimate that the number is increasing 7% to 12% a year.

"If upheld, the California ruling will send shock waves nationwide," says Richard Kahlenberg, the author of a number of books on education. He says the case "pits those who believe parental rights are paramount against those who place a premium on well-educated citizens."

A Little Background Information on my "Subway Excludes Homeschoolers" Posts & The Apology from Subway

Apparently, my posts about Subway excluding homeschoolers from their recent writing contest has caused quite a debate in the world of homeschoolers. I have been being called a "loon," among many other NASTY things (including many swear words) from fellow homeschoolers. Since Subway has issued an apology, I have since deleted my original post for obvious reasons....action is not needed any longer and I don't want my post to make it seem as though there's still reason to speak up about the matter. BUT...for those who are hearing about my postings (as if I'm the only one posting/blogging/e-mailing about this), here's some background as to why I thought this should be spoken out against.

Since this has caused such a reaction, I would like to explain my reasons behind my postings. I imagine that I would tend to be a little more sensitive about things like this since I grew up in a "pioneer" homeschooling family, when homeschoolers were not as pleasantly looked upon as they are today (to say the least). We all worked hard for the freedoms that all homeschoolers enjoy today (very leisurely, for the most part, I must say), and I have a hard time taking them for granted and looking the other way when we're "excluded" from something like this contest. I've seen how far we've come as homeschoolers and I am very careful to make sure that we keep these precious freedoms that we all enjoy today!

Will Subway's contest prevent us from homeschooling in the future; will it prohibit our hard-earned freedom to homeschool? No. BUT it does limit us in the educational arena. We are prohibited, solely because of our choice in how we educate our children, of entering an educational contest. Where's the progress in that? Is there not a way that homeschoolers can be included?

It seems to me that my blog has attracted much attention on this subject. However, I am not the only person who viewed this issue in this way. The Home School Legal Defense Association (HSLDA) wrote Subway a letter AND received a formal apology from Subway. The American Family Association (AFA) has also taken a stand and received an apology, and many other pro-homeschool publications wrote outraged editorials, as well. Below is the HSLDA's original letter and the apology from Subway, for those who are interested in the outcome of this.

Sincerely,

Lisa Metzger

Open Letter to Subway: Let Homeschoolers Enter Contest

May 27, 2008

Frederick A. DeLuca, President
Subway Restaurant Headquarters
325 Bic Drive
Milford, CT 06461-3059

Dear Mr. DeLuca:

By way of introduction, I am the President of Home School Legal Defense Association (HSLDA) and we represent 83,000 member families nationwide. This letter is to draw attention to your “Every Sandwich Tells a Story Contest,” and the unfortunate fact that homeschoolers are not allowed to participate.

The rules clearly state: “Contest is open only to legal residents of the United States who are currently over the age of 18 and have children who attend elementary, private or parochial schools that serve grades PreK-6. No home schools will be accepted (emphasis added).”

It is extremely disappointing that Subway would choose to exclude the estimated 2 million homeschooled students.

We understand that the competition is focused on traditional public and private schools because the grand prize of $5,000 of athletic equipment is designed to be used by a traditional school and not an individual family. A potential homeschool winner, however, could simply donate the grand prize to a public or private school of their choice or to a homeschool sports league.

Homeschooling is a thriving educational option. All the available research shows that homeschoolers are excelling academically and socially. We do not deserve to be overlooked.

We hope that you will reconsider the rules of your competition and choose to amend them to include homeschoolers.

Sincerely,

J. Michael Smith
HSLDA President

Subway Apologizes

HSLDA is pleased to pass along the following apology from Subway restaurants.

To HSLDA:

We at SUBWAY restaurants place a high value on education, regardless of the setting, and have initiated a number of programs and promotions aimed at educating our youth in the areas of health and fitness.

We sincerely apologize to anyone who feels excluded by our current essay contest. Our intention was to provide an opportunity for traditional schools, many of which we know have trouble affording athletic equipment, to win equipment. Our intent was certainly not to exclude homeschooled children from the opportunity to win prizes and benefit from better access to fitness equipment.

To address the inadvertent limitation of our current contest and provide an opportunity for even more kids to improve their fitness, we will soon create an additional contest in which homeschooled students will be encouraged to participate. When the kids win, everyone wins!

What are “living books” you ask? Well, let me tell you…

  • A living book is written by a single person, a real and knowable person.
  • A living book is a literary expression of the author's own ideas and love of the subject.
  • A living book is personal in tone and feel. It touches the heart and emotions, and the intellect.
  • The author of a living book addresses the reader as an intelligent and capable thinker.
  • In a living book, ideas are presented creatively in a way that stimulates the imagination.

This idea of a living book stands in stark contrast to a textbook. So what then is a textbook? Read on:

  • A textbook is a non-literary expression of collected facts and information.
  • A textbook is impersonal in tone and feel. It touches only the intellect.
  • In a textbook, facts are presented without creativity in a way that deadens the imagination.
